Non-Immigrant Visas That WeTypically Handle

TEMPORARY WORK VISA

Temporary worker visas are for those who want to enter the United States for employment lasting a fixed period of time, and are not considered permanent or indefinite. Most of these visas requires the prospective employer to first file a petition with U.S. Citizenship and Immigration Services (USCIS). 

  • H-1B: "Specialty Occupation" requires a higher education degree or its equivalent. 
  • H-1C: For Registered Nurses.
  • H-2A: For Temporary Agricultural work.
  • H-2B: For Temporary Workers in other professions.
  • H-3: For Trainees.

STUDENT VISA

A student visa allows you to study in the United States. Your course of study and the type of school you plan to attend determine whether you need an F visa or an M visa.

  • F-1: For those who are enrolled in one of the following: University or College, High School, Private Elementary, Seminary, Conservatory.
  • M-1: For those who are enrolled in a Vocational or other recognized nonacademic institution, other than a language training program. 

FIANCE VISA

In general, the foreign-citizen fiancé(e) and U.S. citizen sponsor must have met in person within the past two years. However, USCIS may grant an exception to this requirement, based on extreme hardship. Below are examples of common types of K Visas. 

  • K-1: For the fiancé of a U.S. citizen for the purpose of marriage.
  • K-2 & K-4: For the minor children of fiancé or spouse.

TEMPORARY VISITOR VISA

Visitor visas are nonimmigrant visas for those who want to enter the United States temporarily for business (visa category B-1), for tourism (visa category B-2), or for a combination of both purposes (B-1/B-2).

B-1 covers the following:

  • Consult with business associates.
  • Attend a scientific, educational, professional, or business convention or conference.
  • Settle an estate.
  • Negotiate a contract.

B-2 covers the following:

  • Tourism.
  • Vacation (holiday).
  • Visit with friends or relatives.
  • Medical treatment.
  • Participation in social events hosted by fraternal, social, or service organizations.
  • Participation by amateurs in musical, sports, or similar events or contests, if not being paid for participating.
  • Enrollment in a short recreational course of study (not for credit toward a degree).
